AUGUSTA — An Augusta man who allegedly punched a woman in the head, slapped her so hard she fell down, and threatened to kill her, was indicted Oct. 16 on domestic violence charges.
Dustin E. Gay, 41, of Augusta, was indicted by a Kennebec County grand jury on two counts of domestic violence aggravated assault, two counts of domestic violence assault, and one count of domestic violence criminal threatening.
The woman he allegedly assaulted said he punched her in the head, slapped her in the face so hard she lost her balance and fell, and held a charging cord to her neck and said he was going to kill her. Police noted when they interviewed her she had a red mark on her neck and blood on her head around her earring, and was limping, according to an affidavit filed by Augusta police Officer Erik Maheu.
The woman also initially said the man had hit her with his car, injuring her leg. She later recanted that allegation in a statement to police and said he was following her in his car, while she was walking, and she thought he was going to hit her. She said he stopped and tried to get her into the car and she stepped back, tripped and injured her ankle.
Later, she told police he punched her in the ankle.
One of the two Class B domestic violence aggravated assault charges for which Gay was indicted, however, still states he did “intentionally, knowingly, or recklessly cause bodily injury” to the woman, “with the use of a dangerous weapon, a motor vehicle.” A Class B crime is punishable by up to 10 years in prison.
The incidents allegedly took place July 21, in Augusta, after the pair had been out to multiple bars and restaurants in the city, and they argued, both while out, and after they’d returned home.
An indictment is not a finding of guilt but indicates enough evidence exists to proceed toward trial. Also indicted by a Kennebec County grand jury, which handed up its findings Oct. 16, were:
