A Clinton man was indicted on a charge of attempted murder for allegedly shooting his girlfriend in the neck.
Andrew L. Fertig, 69, allegedly shot a 74-year-old woman in the neck during an argument Oct. 19, 2024 at the 791 Hill Road home in Clinton they shared.
He was arrested and charged with domestic violence elevated aggravated assault.
In December a Kennebec County grand jury also indicted him on charges of attempted murder and domestic violence reckless conduct, in addition to the previous charge.
The woman survived and was taken by LifeFlight of Maine to Northern Light Eastern Maine Medical Center in Bangor for treatment.
The woman, interviewed in the hospital by Clinton Police Chief Rusty Bell, said Fertig was really drunk and telling her to get out of the house. She told him it was her home and she had established residency and refused to leave, saying he’d have to go to court and have her evicted.
She told police Fertig didn’t like that and went into his bedroom, came back out and said something like there were other ways to get her out of the house. The woman said he extended his arm, she told him to go ahead, and he shot her with a gun she had not seen.
She said she thought he was trying to shoot over her and into the couch to intimidate her, but missed and shot her. She said when he pulled the trigger of the gun it felt like an explosion and when she opened her eyes “Andrew was standing over her saying I am going to jail.”
The woman told Bell that Fertig had grabbed her by the arm and the throat in the past.
Fertig told authorities he was drunk at the time of the shooting and had made the biggest mistake of his life, knew he was going to have to go to jail, and knew what he was doing when he pulled the trigger. He said he didn’t want the woman to die and knew he’d made a mistake, the affidavit stated.
Clinton Sgt. Roger Smith filed an affidavit stating that when he went into the home there was a black handgun sitting on a bed and a holster close to the gun. Smith saw a bloodstain on the couch in the living room of the home. A bullet was recovered from the wall behind the couch, and a 9 mm casing was found on the living room floor.
Fertig is being held at Kennebec County jail on $1 million bail, jail officials confirmed.
The attempted murder and domestic violence elevated aggravated assault charges are Class A felonies, punishable by up to 30 years in prison.
An indictment is not an indication of guilt, but it indicates that there is enough evidence to proceed with formal charges and a trial.
