SKOWHEGAN — A 63-year-old Madison man with a history of sexual offenses is set to serve at least one year in prison after pleading guilty Tuesday to several child pornography charges.
John Wayne Peters entered guilty pleas to nine counts of possession of sexually explicit material of a minor younger than 12, and one count of failure to comply with the Sex Offender Registration and Notification Act at a hearing in Skowhegan before Superior Court Chief Justice Robert Mullen, court records show.
Peters was sentenced on the first count to five years in prison, with all but 12 months suspended, to be followed by two years of probation, according to court records.
One-year sentences for each of the other nine counts are to be served concurrently with the five-year, partially suspended sentence.
All convictions were Class C offenses, which carry a maximum penalty of five years in prison and a fine of up to $5,000.
Terms of Peters’ probation include that he complete evaluation and counseling for sexual offenders, have no direct or indirect contact with children younger than 18 and comply with the Sex Offender Registration and Notification Act requirements, records show.
If Peters violates the conditions of his probation, he could be ordered to serve the suspended portion of the prison sentence.
Peters was arrested in June after the Somerset County Sheriff’s Office investigated a complaint it had received in May, Sheriff Dale Lancaster said previously.
Detective Jeremy Leal found that Peters’ cellphone contained explicit photos and videos of child pornography, which was verified by a forensic examination by the computer crimes unit of the Maine State Police, Lancaster said at the time of Peters’ arrest. Leal subsequently obtained an arrest warrant.
Peters is a lifetime registrant on Maine’s Sex Offender Registry due to previous convictions in Maine and New Hampshire, according to the Sheriff’s Office.
Maine’s online database of sexual offenders shows that Peters has two previous convictions of unlawful sexual contact in Maine, and has been sentenced for aggravated felonious sexual assault and sexual assault in other states.
As of Tuesday morning, Peters was incarcerated at the Somerset County Jail in Madison, online jail records show. Peters has been held there since he was arrested.
